What is an Occupancy Permit vs. a Business License?

A Zoning Certificate (also known as an Occupancy Permit) is a permission issued by the Zoning Department that identifies whether a given Proposed Use / Business Operation conforms to the applicable Zoning Bylaw of the Subject Site.

Parking Rates are set by the relevant section of the Parent Zoning Bylaw, and Permitted Uses are also set by the Site Specific provisions of the Subject Site. If the Zoning Review reveals deficiencies of Parking for All Uses on-site, or a Use being not permitted, then a Minor Variance may be required.

Zoning Certificate of Occupancy Permits ought to be the first vehicle for compliance when submitted a Building Permit or a Change of Use or License Application to Operate and Occupy a Business in Ontario.

An Operating License (also known as a Business License) is an annual Permit that requires the submission of Ownership and Tenant Documents certifying that the proposed Business is permitted to Operate out of the Subject Site.

Among other things (e.g. Articles of Incorporation, Acknowledgement of Directors, Registered Business Name etc.) a Zoning Certificate of Occupancy Permit is an essential requirement to obtaining a Business License.

In other words, a Business cannot obtain an Operating License from the Municipality without a valid Zoning Certificate.
